1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Snapfin ("Company," "we," "our," or "us") governing your access to and use of the Snapfin mobile application, website, and related services (collectively, the "Service"). By downloading, installing, or using the Service, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility and Age Requirements

You must be at least 13 years of age to use Snapfin. By using the Service, you represent and warrant that you meet this age requirement. Users between 13 and 18 years of age must have the consent of a parent or legal guardian. We reserve the right to terminate accounts of users found to be under 13.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Subscriptions and Billing

4.1 Subscription Plans

Snapfin may offer free and paid subscription tiers. Paid features are billed on a recurring basis (monthly or annually) as selected at the time of purchase.

4.2 Billing

By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. Subscription fees are charged at the beginning of each billing cycle.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the applicable app store (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period. We do not provide pro-rated refunds for partial billing periods, except where required by applicable law.

4.4 Price Changes

We reserve the right to modify subscription pricing with reasonable advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.5 In-App Purchases

Purchases made through the Apple App Store or Google Play are subject to those platforms' respective terms and refund policies.

5. AI Fish Identification — Disclaimer

Snapfin uses artificial intelligence to identify fish species from photos. AI identification results are provided for informational and educational purposes only and should not be solely relied upon for legal compliance decisions. Species identification accuracy may vary based on photo quality, lighting, species similarity, and other factors.

You are solely responsible for verifying the identity of any fish and for complying with all applicable federal, state, and local fishing regulations. Snapfin is not liable for any fines, penalties, or legal consequences arising from reliance on AI identification results.

6. GPS-Based Fishing Regulations — Disclaimer

Snapfin provides real-time fishing regulation information based on your GPS location. This information is sourced from publicly available regulatory data and is updated regularly. However, fishing regulations change frequently, and we do not guarantee that the regulations displayed are current, complete, or accurate.

Always verify current regulations with the applicable state or federal wildlife agency before fishing. You are solely responsible for compliance with all applicable fishing laws and regulations. Snapfin is not liable for any citations, fines, or legal consequences resulting from reliance on regulation information provided by the Service.

7. User Content

You retain ownership of photos, catch data, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Snapfin a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely for the purposes of operating and improving the Service.

You agree not to submit content that:

• Violates any applicable law or third-party rights
• Is fraudulent, misleading, or deceptive
• Contains malware, viruses, or harmful code
• Infringes any intellectual property rights

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Scrape, harvest, or collect data from the Service without authorization
• Circumvent any security or access control measures
• Impersonate any person or entity
• Interfere with the proper functioning of the Service
• Use the Service to facilitate illegal fishing or poaching activity

9. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, icons, and the AI models — are owned by Snapfin or its licensors and are protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNAPFIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Snapfin and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by sending a notification through the app or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 9, 10, 11, 12, and 13 survive termination.
